Terms of Service

These Terms of Service ("Terms") govern your access to and use of topdata.com.ph (the "Site") and the careers portal operated by TopData Global IT Solutions ("TopData," "we," "us," or "our"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may browse the Site for informational purposes and may submit a contact-form message or job application provided the information you submit is truthful and your own. You agree not to:

  • Use the Site in a way that violates Philippine law or any applicable law in your jurisdiction
  • Attempt to gain unauthorised access to any part of the Site, our systems, or other users' accounts
  • Submit content that is unlawful, defamatory, harassing, or infringes any third party's rights
  • Use automated means (bots, scrapers) in ways that disrupt the Site or circumvent rate limits and bot-protection controls
  • Misrepresent your identity, qualifications, or affiliation in job applications

2. Job Applications

Applying through the careers portal does not create an offer of employment or a contractual relationship. Any subsequent offer of employment is subject to a separate written agreement and successful completion of our hiring process, including background and reference checks where applicable.

Misrepresentation of qualifications, credentials, or work history may result in your application being rejected or, if discovered after hire, in disciplinary action up to and including termination of employment.

3. Public Job Listings API

The Site exposes a read-only public API at /api/jobs for the purpose of allowing legitimate aggregators and downstream consumers to list our openings. Reasonable polling is permitted. Excessive or abusive request volume may result in IP-level rate limits or blocks at our discretion.

4. Intellectual Property

The Site, including its text, graphics, logos, photographs, and code, is owned by or licensed to TopData and is protected by Philippine and international copyright laws. You may not reproduce, distribute, or create derivative works without our prior written consent, except for personal, non-commercial use such as printing a job listing for your own reference.

The "TopData" name and logo are trademarks of TopData Global IT Solutions. Other names mentioned on the Site may be trademarks of their respective owners.

5. Content You Submit

Any information, files, or messages you submit through the Site (contact form, job application, attachments) remain yours. By submitting, you grant TopData a limited, non-exclusive licence to use that content for the purpose of responding to you, evaluating your application, and operating the Site, in accordance with our Privacy Policy.

6. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those sites. Visiting a third-party site is at your own risk and subject to their terms.

7. Disclaimers

The Site is provided "as is" and "as available." We make no warranties, express or implied, regarding the operation of the Site or the accuracy, completeness, or reliability of its content. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, TopData shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site. Our total liability for any direct damages shall not exceed Php 5,000 or the amount you have paid us (if any) in the twelve (12) months preceding the event giving rise to the claim, whichever is greater.

9. Service Engagements

These Terms govern your use of the public Site only. Any business outsourcing engagement between TopData and a client is governed by a separate written master services agreement (MSA) and statement of work (SOW). Inquiries submitted through the contact form do not create a service engagement.

10. Termination

We may suspend or terminate your access to the Site or refuse any submission at our discretion, with or without notice, if you breach these Terms or use the Site in a manner that may cause harm to us or other users.

11. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the courts of Angeles City, Pampanga, Philippines.

12. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the Site constitutes acceptance of the updated Terms.
